Ruling Regarding Renting Clothes To Wear

Question

   What do the scholars say about the issue that some shopkeepers rent out readymade ladies' suits for weddings? Is it permissible for us to rent readymade clothes according to Shariah?

بِسْمِ اللہِ الرَّحْمٰنِ الرَّحِيْمِ

اَلْجَوَابُ بِعَوْنِ الْمَلِکِ الْوَھَّابِ اَللّٰھُمَّ ھِدَایَۃَ الْحَقِّ وَالصَّوَابِ

   In the inquired case, it is permissible for you to rent a readymade ladies' suit for wearing in a wedding in exchange for an agreed-upon fee.

   As stated in Fatawa Alamgiri:

اذا استاجرت المراة درعا لتلبسه اياما معلومة ببدل معلوم فهو جائز

   Translation: If a woman rents a shirt (specifically for female) to wear for a known number of days for a known fee, it is permissible.(Fatawa Alamgiri, Vol. 4, Page 465, Published in Quetta)

   It is stated in Bahr-ur-Raiq:

صح استئجار الدابۃ والثوب لان المنفعة مقصودة معهودة معلومة

   Translation: It is valid to rent an animal or clothing because the benefit is (from the category of) Maqsoodah (meant in terms of Shariah), customary, and known.(Al-Bahr-ur-Raiq Sharh Kanz-ud-Daqaiq, Vol. 7, Page 307, Published in Beirut)

   In Majallat al-Ahkam al-Adliyah:

یجوز اجارة الالبسة

   Translation: It is permissible to rent clothes. (Majallat-ul-Ahkam al-Adliyah, Page 100, Published in Karachi)

   Sadr al-Shari’ah Badr al-Tariqah Mufti Muhammad Amjad Ali Azami رحمة الله عليه writes in Bahar-e-Shariat:

کپڑے کو پہننے کے لیے کرایہ پرلے سکتا ہے۔

   Translation: One may rent clothes to wear.(Bahar-e-Shariat, Vol. 3, Page 128, Maktaba-tul-Madina Karachi)

   Note: It is not permissible to lie by claiming these rented clothes as one's own.
