Is A Muqtadi Required To Perform Sajdah Sahw If He Joins In Tashahhud After It?

Question

   What do the noble scholars and jurists of Islamic law say about the following: When the Imam was sitting in Tashahhud after performing Sajdah Sahw, a person came and joined the Salah. Will he have to perform Sajdah Sahw, even if no mistakes were made when making up the missed Rak’aat?

بِسْمِ اللہِ الرَّحْمٰنِ الرَّحِیْمِ

اَلْجَوَابُ بِعَوْنِ الْمَلِکِ الْوَھَّابِ اَللّٰھُمَّ ھِدَایَۃَ الْحَقِّ وَالصَّوَابِ

   In the enquired situation, the one who joined the Imam in the Tashahhud after Sajdah Sahw will not be liable for performing Sajdah Sahw because of the imam's mistake. The reason is that the Muqtadi himself made no mistake that would obligate Sajdah. Similarly, he didn’t join the Imam in any of the two Sajdah which would obligate him to follow the Imam therein, as following the Imam is obligatory only in those things in which the Muqtadi joins him. That is also why the one who joins the imam in the second Sajdah of Sajdah Sahw will offer the second Sajdah but will not make up for the first.

   It is stated in Mabsoot Al-Sarakhsi:

   فإن سها الإمام في صلاته فسجد للسهو ثم اقتدى به رجل في القعدة التي بعدها صح اقتداؤه، و ليس على الرجل سجود السهو فيما يقضي؛ لأنه ما سها، وإنما يلزمه متابعة الإمام فيما أدرك الإمام فيه وهو لم يدركه في هاتين السجدتين فلا تلزمه بحكم المتابعة

   It is stated in Radd al-Muhtar:

   إذا سجد الإمام واحدة ثم اقتدى به. قال في البحر: فإنه يتابعه في الأخرى ولا يقضي قضاء الأولى كما لا يقضيهما لو اقتدى به بعدما سجدهما

   It is stated in the chapter of Sajdah Sahw in Bahar-e-Shari’at:

   امام کے ایک سجدہ کرنے کے بعد شریک ہوا، تو دوسرا سجدہ امام کے ساتھ کرے اور پہلے کی قضا نہیں اور اگر دونوں سجدوں کے بعد شریک ہوا، تو امام کے سہو کا اس کے ذمہ کوئی سجدہ نہیں۔

   Translation: If he joins the Imam after he had performed one Sajdah, he should perform the second Sajdah with the Imam, but there is no Qada (making up) for the first. If he joins after both Sajdah, he isn’t liable for any Sajdah because of the Imam’s forgetfulness. (Bahar-e-Shari’at, Vol. 1, p. 716, Publ. Maktaba-tul-Madinah, Karachi)

وَاللہُ اَعْلَمُ عَزَّوَجَلَّ وَرَسُوْلُہ اَعْلَم صَلَّی اللّٰہُ تَعَالٰی عَلَیْہِ وَاٰلِہٖ وَسَلَّم

(Allah Almighty knows best and His Messenger صَلَّى اللهُ عَلَيْهِ وَاٰلِهٖ وَسَلَّم knows best.)
