Question
What do the noble scholars and jurists of Islamic law say about the following: If one forgot to perform Idtiba’ in the first two rounds of the tawaf for Umrah and then remembered in the third round, will he now perform Idtiba’ during tawaf or not? Also, is it necessary to give Dam?
بِسْمِ اللہِ الرَّحْمٰنِ الرَّحِیْمِ
اَلْجَوَابُ بِعَوْنِ الْمَلِکِ الْوَھَّابِ اَللّٰھُمَّ ھِدَایَۃَ الْحَقِّ وَ الصَّوَابِ
If one forgets to perform Idtiba’ (uncovering the right shoulder by wrapping the Ihram under the right arm and over the left shoulder) in the beginning rounds of the tawaf for Umrah, he should perform it whenever he remembers before completing the seventh round. Idtiba’ in all seven rounds of Umrah is Sunnah; it in its entirety is the allocated time for it and doing Idtiba’ for any less than that is against the Sunnah and Makruh. Therefore, just because it wasn’t done in a few rounds doesn’t mean that the ruling be given for it to be left in the remaining rounds as well. In this case, there is no Kaffarah (Dam or Sadaqah) of any kind.
It is stated in Sharh Al-Lubab:
سنن الطواف الاضطباع ای في جميع اشواط الطواف الذی سن فیہ کما صرح بہ ابن الضیاء
(Sharh Al-Lubab, Chapter: Sunnan of Tawaf, p. 176, Publ. Dar Al-Kutub Al- ‘Ilmiyah)
It is stated in Radd Al-Muhtar:
إن محله المسنون قبيل الطواف إلى انتهائه لا غير
(Radd Al-Muhtar ‘Ala Al-Durr Al-Mukhtar, Vol. 2, p. 481, Publ. Dar Al-Fikr)
It is stated in Bahar-E-Shari’at:
طواف کے ساتوں پھیروں میں اِضطباع سنت ہے اور طواف کے بعد اِضطباع نہ کرے۔
Translation: It is Sunnah to perform Idtiba’ in all seven rounds of tawaf and it shouldn’t be done after tawaf. (Bahar-E-Shari’at, Vol. 1, Sect. 6, p. 1101, Publ. Maktaba-Tul-Madinah)
وَ اللہُ اَعْلَمُ عَزَّ وَ جَلَّ وَ رَسُوْلُہ اَعْلَم صَلَّی اللہُ تَعَالٰی عَلَیْہِ وَ اٰلِہٖ وَ سَلَّم
(Allah Almighty knows best and His Messenger سَلَّمصَلَّی اللہُ عَلَيْهِ وَ اٰلِهٖ وَ knows best.)
